Standing Affirm: ERPO Documentation Must Reflect Extreme Risk

“Despite public perception, enforcing an extreme risk protection order is not immediate and may take several days. An ERPO also requires the coordinated actions of the petitioner, law enforcement officials, and the judicial system. The person being served will continue to have access to his firearm and retain the right to procure new ones until the ERPO has been enforced. This process could be delayed even longer if the case crosses legal jurisdictions or state lines, and may stall after business hours or on weekends.”
